The 12 clauses to check
- Permitted use: explicitly "commercial kitchen / food preparation and delivery".
- FSSAI NOC: owner agrees to sign the NOC for your licence at this address.
- Rent and escalation: monthly rent and yearly increase (5–10% is typical).
- Security deposit: amount, refund timeline and allowed deductions.
- Lock-in and notice: lock-in months and notice period for both sides.
- Power load: sanctioned load, 3-phase availability, who pays upgrades.
- Gas: permission for commercial LPG banks or piped gas.
- Exhaust and chimney: permission to install ducting and where it can vent.
- Fit-out period: rent-free weeks for setting up.
- Repairs and maintenance: structural vs day-to-day — who pays what.
- Equipment inventory: list of equipment included, with condition.
- Exit and handover: what you can remove and the condition on handover.
Before you pay the deposit
- Visit the premises in person, at cooking hours if possible.
- Check the owner's ownership proof and electricity bill name.
- Confirm neighbours/society allow commercial cooking.

Does the owner need to give consent for FSSAI licence?
Yes. FSSAI applications need proof of possession of the premises, usually the rent agreement plus an NOC from the owner. Make sure the agreement allows food business use.
What lock-in period is normal for a kitchen rental?
6–12 months is common. Try to keep lock-in short for a new brand, with a clear notice period (1–3 months) after it ends.
Should the agreement be registered?
Agreements longer than 11 months generally need registration in most states; many owners use 11-month agreements. Ask a local lawyer for your state's rules.
